My husband invited his parents in Canada on super visa three years ago. They stayed here six months and went back. They have no intention of coming back to Canada. We have two children. Now, I want to invite my parents on super visa. Would our family size be 6 or 8?

For a super visa application, your family size would be calculated as 8 members, not 6. This is due to the reason that when your husband invited his parents to Canada on a super visa, you were most likely a co-signer for the application. Now, when you will be sponsoring your parents, your husband would likely co-sign the invitation and as a result, your family size would be 8 members. Even if your in-laws have no intention of coming back to Canada but they have been issued a super visa so there is a possibility they could come back to Canada; therefore, your family size would be 8 members.

The validity of the super visa issued to your in-laws is in effect till its expiry whether they want to come back or not. You will have to take them into consideration when applying for Super Visa for your parents. All the family members in your family have to be included in addition to the people sponsored before and people being sponsored now. So the count for the qualifying Income is 8 and NOT 6.
