My sister wants to sponsor her husband from India. She is a born Canadian citizen. She had gone to visit India with her aunt where she found a highly educated partner. A simple marriage ceremony was performed because of Covid-19, because a big gathering was impossible. She is receiving CERB since she returned to Canada. Her employer has laid off all of his employees and is planning to file bankruptcy soon. Her income for the past year was approximately $24,000. Being a CERB recipient, can she file a spousal sponsorship application?

Yes. She is eligible to sponsor her husband for permanent residency in Canada. Taking the government’s emergency help plan ‘CERB’ does not make her ineligible to sponsor her husband. CERB income will be counted towards your income to sponsor your family members. Moreover, your cousin has a job which is just temporarily interrupted by coronavirus pandemic situation. She can use her recent year’s income return and pay stubs to prove her financial ability to support her husband.

Yes, she can sponsor her spouse while receiving CERB. There is no income requirement for sponsoring your spouse as long as you can prove you will be able to support your spouse.
