    An applicant for the home child care or home support worker must have following basic eligibility requirements:

    1. Must have post secondary educational credential of at least 1 year in Canada or equivalent to it. (foreign educational credentials must be evaluated)

    2. Must have CLB 5 level in English or NLLC in French for all 4 language skills

    3. Past experience or training in the same profession (caregivers).

    4. Must have a genuine and valid job offer in Canada

    As of June 18, 2019, there are 2 pilots which will let you hire a foreign in-home caregiver:

    1. Home Child Care Provider Pilot, NOC 4411 (excluding foster parents)

    2. Home Support Worker Pilot, NOC 4412 (excluding housekeepers)

    There is no need to get an LMIA approved for hiring a Nanny under these two new pilot programs.

    You can apply and obtain ‘Verification of Status Document’. It takes 4 to 6 weeks approximately to receive it. Now you will not get a certified copy of Record of Landing (IMM-1000) but you will get a Verification of Status document that contains info about the person.

    Biometrics are valid for 10 years. If you have given biometrics in the past 10 years, you will not be asked again for biometrics enrolment. However, if you have previously applied for a temporary resident visa, and now you apply for permanent residence, then IRCC will ask for biometrics again.

    You have to include the persons who are being invited to Canada on super visa. If you are single person and you are inviting both your father and mother. Then your family size is 3 (You+Father+Mother=3).

    The LICO income you need to invite them on super visa for the year 2020 is $39,672. You need to provide your Notice of Assessment to show your income. Line 150 on your Notice of Assessment will be taken as your income.

    In Canada to study as an international student, there are various expenses and cost related. Below I will list a few:

    1. Usually tuition fee for colleges and universities are different and cost varies from program to program and their durations as well. But in common, I can say that a semester of about 4 months in Canada as an international student is around $6,500-$9,000. I could be less or more. So for one year program (two semesters), tuition fee could be $16,000 to $20,000.

    2. Apart from tuition, you need living expense and settlement funds, commonly known as GIC savings for international student which is around $10,000 – $11,000.

    3. According to each province, medical insurance for student can be included in tuition or could be paid additionally.

    I hope you can estimate the approximately associated costs while planning to get a study permit in Canada.

    Dear Baljit

    Your mother can not extend her temporary resident visa. She can only extend her stay / entry in Canada. A new Super visa can only be issued from outside Canada.

    If your mom travels on super visa (with three months visa duration left), she will have to apply for her extend of stay. Alternatively, you can file a new super visa for your mother so that she gets a visa for the duration of the length of her passport’s validity. She can get her passport renewed if it is expiring within 365 days.

    Canadian experience class requires a candidate to have at least one year of Canadian full time work experience under NOC 0, A, or B skills. Your Canadian post secondary education will also contribute to total points to become eligible under CEC. But you need to complete required work experience to apply for CEC.

    You can NOT skip any dates when you are filling out any application to IRCC. If you do not know the dates of your travels to the USA, try to recall those dates by looking at tickets, boarding passes, hotel bills, calls/emails you may have made to the person whom you were visiting etc. If you are still unable to get any idea about those travel dates, you can request for your travel history from the United States government.

    If you don’t know the information asked on the form, enter ‘unknown’ in the spaces provided. If it doesn’t apply to you, you can write ‘Not Applicable’ or ‘NA’.

    If you don’t have enough information about your parents or grandparents, your application may be delayed and/or IRCC may not be able to assess your application.

    Yes, you have to stay in Canada if you want to maintain your status in Canada because you can lose your permanent resident status. If you haven’t been in Canada for at least 730 days during the last five years, you may lose your PR status.

    To keep your permanent resident status, you must have been in Canada for at least 730 days during the last five years. These 730 days don’t need to be continuous.

    You can not live in Canada more than the authorized stay of six months in Canada which is applicable to a visitor. If you want to stay in Canada for longer than that you need to extend your stay in Canada as a visitor.

    If you have a work permit in Canada, then you are allowed to work and remain in Canada till the expiration of that work permit. If you are not working, there is no need to change it to a temporary resident visa. You can stay in Canada for six months without working because you have valid visitor visa. But after six months, you have to either leave Canada immediately or apply for extension as a visitor.

    If there is not enough space on the application form, you can add an additional sheet or the same application form page, addressed carefully with Application Form number (e.g. IMM0008), question number (part B- question 6), and page number. You can attach this additional sheet along with the relevant application form and add it in the paper application.

    All the family members of your sister’s family will have different visa requirements. The husband who is Australian citizen and the son who is British passport holder, they both need to apply eTA. The other son who is USA citizen is exempt from the eTA requirement, he does not need an eTA to travel to Canada. Your sister being an Indian passport holder needs to apply for a temporary resident visa to come to Canada.

    Yes, your cousin will need to show that he has enough funds to support his temporary stay in Canada while on a study permit. The amount that your cousin needs to show is CAD$10,000 (does not include tuition fees). Additional funds will be required for every family member who will accompany you to Canada.

    Pursuant to s.28(1) IRPA: A permanent resident must comply with a residency obligation with respect to every five-year period.

    The five year period as mentioned in s.28(1) IRPA is explained in detail in a.28(2) which states:

    The following provisions govern the residency obligation under subsection (1):

    • (a) a permanent resident complies with the residency obligation with respect to a five-year period if, on each of a total of at least 730 days in that five-year period, they are
    • (i) physically present in Canada,
    • (ii) outside Canada accompanying a Canadian citizen who is their spouse or common-law partner or, in the case of a child, their parent,
    • (iii) outside Canada employed on a full-time basis by a Canadian business or in the federal public administration or the public service of a province,
    • (iv) outside Canada accompanying a permanent resident who is their spouse or common-law partner or, in the case of a child, their parent and who is employed on a full-time basis by a Canadian business or in the federal public administration or the public service of a province, or
    • (v) referred to in regulations providing for other means of compliance;

    In simple terms, in order to maintain your status as a permanent resident in Canada, you must have been physically present in Canada for a minimum of 730 days in the previous 5 years. There are exceptions to this requirement as listed in s.28(1)((ii)), (iii), (iv), (v) IRPA.

    Yes. You can apply for PGWP again but it depends on other eligibility requirements as well.

    If your study permit is valid and you are in the time period of 180 days from your date of completion of studies , you can apply for a PGWP again.

    If your study permit is expired and you are within 180 days from your study completion date, you can apply for a restoration of status & a PGWP together. You have to pay an additional $200 for the work permit along with $255. Also, you need to pay $150 for your study permit restoration as well to become eligible to have PGWP.

    Immigration Refugees & Citizenship Canada (IRCC), formerly Citizenship & Immigration Canada (CIC) stopped issuing laminated Canadian citizenship cards in February 2012. Not sure about the reason but I think perhaps government may have realized that a laminated document becomes void and it does not make sense to issue void cards to prove their status.

    To change your name on your citizenship card, you will first need to get your name legally changed through the office of Registrar General for your province in Canada. Moreover, you will receive a Canadian citizenship certificate instead of a card now. To change name on citizenship certificate, click on the following link:

    If you have never worked in Canada, you are not eligible to apply under Canadian Experience Class. No matters if your scores are more than cut-off. You need to meet the minimum eligibility criteria of Canadian experience class which is that you must have worked for at least one year in Canada on a NOC O,A, or B.

    In order to apply for a Canadian study permit, prospective international students must first obtain a letter of acceptance from a Designated Learning Institution (DLI). As each institution may have different admission requirements and application processes, interested applicants may contact the desired institutions individually. In order to obtain a Canadian study permit to attend a post-secondary institution in Quebec, most students require a Certificat d’acceptation du Québec (Quebec Acceptance Certificate, or CAQ). You need to get this CAQ first only then you are able to apply study permit application to IRCC.

    The official confirmation is when she receives the letter of completion or confirmation of graduation letter from her college.     There is no income requirement to sponsor your spouse or partner or a dependent child. You only need to show that you have enough money to meet the income requirements if:

    1. you’re sponsoring a dependent child that has 1 or more dependent children of their own, or

    2. you’re sponsoring a spouse or partner that has a dependent child, and their dependent child has 1 or more children of their own.

    Yes. You can leave Canada after you submit your citizenship application. But keep in mind that your citizenship test and oath ceremony will be only conducted in Canada; therefore you should be present in Canada at that time. In case you would not be able to attend any of these events, you need to inform IRCC within time.

    As per IRCC, if an institution allows for back-to-back scheduled breaks, thus creating a break period longer than 150 consecutive days, then students are only eligible to work off campus during the first 150 consecutive days. They cannot work for the entire break if it is longer than 150 consecutive days. You can work more than 20 hours.

    No. A Canadian offer of employment is not required in order to qualify under the Federal Skilled Worker Class, but one could get you up to 15 points and thereby improve your chances of being eligible. A valid job offer from a Canadian employer can benefit the applicant between 50 to 200 points under CRS, depending on the type of job.

    No. For international graduates, work experience does not have to be related to education, as long as the candidate has accumulated the work experience after graduating from an approved Canadian post-secondary educational institution. There is no educational requirement set for CEC, but you can add your education to your Express Entry profile to increase your CRS score to get an ITA.

    If you change post-secondary schools, the school you plan to change to must also be a DLI. You need to inform IRCC about it. You can use the change of DLI tool by making a CIC online account.

    It also depends on the details of study and conditions of your stay as mentioned on your study permit. If your conditions of study will change by changing institution, then you need to amend your study permit.

    In the history section, you will see different types of information to fill out: Work history, Education history, Personal history, and Address history. You need to put the start dates in the ‘From’ section and the end dates in the ‘To’ section. If you are currently doing the same activity or staying at the same address, you can put the date as ‘Today’ or ‘Current’. In case you don’t remember the dates, use your best guess and explain that you are making an approximation.

    Yes, as long as you are not inadmissible for any other reason. When a court in any country decides that you are not guilty of committing a crime, you are not inadmissible for that crime and you can likely enter and stay in Canada.

    DLI means Designated Learning Institution which is assigned to a post-secondary institution once IRCC receives confirmation of its designation status from its provincial or territorial Ministry of Education.

    Biometric Identification is a way for Immigration system of Canada to identify a person correctly. Biometrics are done by taking fingerprints and a photo of the person.

    Yes. If you are not available on the date and time of your appointment, you can write a letter of explanation to IRCC and send it by mail, or online, using the web form service. IRCC will reschedule your appointment on a different date. But missing your citizenship test can delay your application.

    Your time towards citizenship is calculated after you have received permanent residency in Canada. You may still get some amount of time towards your physical presence during your temporary resident stay in Canada. Since you were a student, you will only be eligible to count half of your time that you stayed in Canada with a temporary resident visa (this time benefit cannot exceed 365 days in total). The general requirement is that you need to be present in Canada for at least 1095 days in the five years immediately before the date of your application signed.

    You need to get an ECA for any education that you have completed outside Canada. By getting your foreign degree/diploma evaluated, you will be able to find out the equivalency of that credential in Canada. After getting your ECA, you can then get your foreign educational credentials accepted in Canada under express entry and you will receive the associated CRS points for that.

    No police clearance or verification is required for study permit for Canada. However, if requested by IRCC, you must provide police clearance.

    No. You can not work more than 20 hours a week while on a study permit in Canada. If you never worked in Canada during your first two semesters, it does not provide you any extra time to work in third semester. If you have a study permit and are enrolled full-time in an academic, professional, and eligible institution, you are allowed to work for up to 20 hours per week.

    When you have an eTA, you must follow Canada’s time limitations for visits to the country. The travel authorization allows you to stay in Canada for up to six months at a time. Once this time is up, you must leave the country.

    If you have completed studies in Canada in a DLI college/ university/educational institute, you will get benefit when you will apply for permanent resident application under economic classes of immigration such as Canadian experience class, federal skilled worker, federal trade worker, PNP etc.

    After graduation, you can stay in Canada if you want to apply for post graduation work permit.

    Also, if you have been offered a job and you will apply for LMIA-based work permit. Otherwise you can only stay in Canada until you allowed stay.

    You can count your work experience from January 03, 2019. Because when you apply post graduation work permit with a valid study permit, you are authorized to work full time in Canada and you can claim this work experience for Canadian experience class.
