    You are eligible to create an express entry profile once you are done with 12 months of work experience. If your work experience is completing on the same day of creating profile that is not an issue. Refer to the link for better understanding of eligible work experience:

    The TR to PR pathway’s eligibility requirements clearly state that the person:

    be in Canada

    have valid status in Canada

    plan to live outside of Quebec

    meet or exceed the language requirements

    be currently employed

    have eligible work experience

    not be a refugee claimant in Canada

    So, refugee claimant in Canada are not eligible to apply under this program.

    As per the checklist IMM5627, you can submit:

    Bank statements

    Notice of assessment from CRA for the five years

    any club memberships for the last five years

    Basically you need provide the documents which are relevant to the determination of residency obligation for last five years or since the date they became PR of Canada.

    Yes. It is totally acceptable by IRCC if you want to hire a relative as your child’s caregiver. There is no legal prohibition against hiring a relative. The need has to be beyond doubt bona-fide, and all other employment conditions and eligibility requirements met as well.

    Yes. You can apply for both applications. You will need to pay the respective application fees for each option you pursue. Once you get your PR via one of them you have to decline either one of them. You will have to choose under which one the permanent resident status will be granted.

    Due to the ongoing situation with COVID-19, some panel physician offices may be closed or have limited appointment availabilities. If you are having difficulty getting your IME completed before you apply, you should provide the proof that a medical appointment is scheduled, including the name of the panel physician and the date and time of the appointment. You should also provide a letter of explanation of best efforts.

    A police certificate is a statement that you don’t have a criminal record or, if you have one, a copy of your criminal record. Your application is refused because of invalid PCC from the country of origin. When you visited your country of origin for three weeks, the PCC documents you have been issued before that became invalid. You and your family were required to get a new PCC after your last day stayed in that country.

    Now, you need to apply for a new PCC, and submit your application by repeating the whole process.

    If you have technical issues during your scheduled interview and you could not attend your interview. You need to wait for IRCC’s further instructions about the processing of your application. As per the officer said, IRCC will contact you and reschedule the verification interview for a next date.

    I believe you might have filled in the information from your Indian national ID, i.e. Aadhaar Card. If yes, then you need to provide a photocopy of the Aadhaar Card along with other supporting documents. Basically you need to send the whole application again with proof of address with Aadhaar Card from India. In Case you do not have copy of Aadhaar card, then you need to fill up the application for PCC again but skip the option where they ask national ID number. By skipping Indian national ID, i.e. Aadhaar Card, you will not be asked to provide the information.

    For IRCC, you can explain the situation of getting delay in PCC and ask for an extension of time about 60/90 days and provide PCC upon receipt.

    You have received invitation to apply on the details which you have submitted in your express entry profile. There is only one way to go ahead with application by submitting your current passport along with explanation and the proof of application made for passport renewal. You should provide IRCC with the new passport copy as soon as you receive it.

    No. Your application of TR to PR pathway will not get any adverse effects due to location of head office. All you need is to provide documentation which proves that you have worked full-time for one year in Canada on this position. If you are working in Manitoba and the head office is located in New Brunswick but your employer is same, you are eligible to use this work experience for your PR application.

    You would be only eligible if you have completed, prior to the date on which the application for permanent residence is received and no earlier than January 2017, a program of study at an eligible Designated Learning Institutions in Canada. You also have been granted with eligible degree (Associate, Bachelor’s, Master’s, or Doctorate), diploma, certificate, or attestation.     Yes. The Government of Canada has announced a new policy to help former international students to live in, work in and continue contributing to Canada. Under this policy, you can be eligible to get an extension of 18 months of PGWP in Canada. To be eligible for this open work permit, you must meet the following 5 requirements:

    1. Your post-graduation work permit (PGWP) is expired on or after January 30, 2020, or will expire within 4 months from the date you apply for this open work permit.

    2. You were in Canada as of January 27, 2021, when the public policy took effect, and have stayed in Canada since then.

    3. You either

    have a temporary resident status (this could be from having a valid PGWP, visitor record, or another permit that allows you to stay in Canada), or

    lost your temporary resident status, but you’ve already applied to restore it, or

    lost your temporary resident status, but you’ll apply to restore it at the same time as applying for this open work permit

    4. You include in your application that you’re applying for an open work permit under this public policy.

    5. You have a valid passport.

    The work permit will be issued for up to 18 months from the date of approval or until your passport expires, whichever comes first. For example, if your passport is valid for 6 months, then you will be issued an open work permit for 6 months.

    To maximize the duration of the open work permit, make sure your passport is valid for at least 18 months from the date of approval.

    For this open work permit, you must apply online by July 27, 2021.

    You are correct that immediate family members fo Canadian citizens and Permanent residents do not need to apply for any permission and to fill any IMM0006 form. I said they need provide a quarantine plan for visiting immediate family members which is made as a statutory declaration. ArriveCan app is social application to get account of the person required to isolate which helps in assisting their health and symptoms for the next 14 days. It also provide the purpose of covid cases in the surroundings of the person.

    Dear Amandeep

    The only proof these days accepted by IRCC, is an official marriage certificate for immigration application. But your mother-in-law is just seeking a travel permission. I would say you should try once by using record of solemnization for your marriage. Attach the proof of your marriage certificate application and all other supporting documents. You need to sign a statutory declaration for your mother-in-law stating you will take her quarantine responsibility.

    On January 5, 2021, IRCC started inviting potential sponsors to apply. These Invitations will be sent over several days. IRCC will accept 10,000 complete applications. If you’re invited to apply, IRCC must get your application package 60 days from the date of your invitation. The deadline is clearly shown on your invitation to apply.

    IRCC has started sending invitations. For 2020’s invitations, IRCC only email you if you’re invited to apply. To make sure you don’t miss our email:

    Check the same email account you used on the interest to sponsor form.

    Check your junk mail and spam folder to see if an email from IRCC is there.

    Yes. The Canadian government has just announced that its Visa Application Centres (VACs) in India will resume services tomorrow, on November 20, 2020. Government stated that it will schedule limited biometrics appointments in Delhi, Chandigarh, Jalandhar, Mumbai, Ahmedabad and Bengaluru. They will not accept walk-in clients at VACs. Rather, appointments must be booked in advance and you can only visit your VAC if you are attending your own scheduled appointment. If Immigration, Refugees and Citizenship Canada (IRCC) has issued a unique Biometric Instructions Letter (BIL) to you, you will receive more instructions to your email ID on file about how to schedule your biometric appointment.

    The government concluded by saying more appointments will gradually become available each week as it phases in services.

    Yes. There are two major exemptions in the income for the tax year 2020 as many sponsors may have been financially impacted by the exceptional circumstances of the COVID-19 pandemic. IRCC is introducing a temporary public policy that will accept the income requirement for the 2020 tax year as per LICO, instead of the LICO plus 30%.

    Moreover, the sponsors will also be able to count the regular Employment Insurance Benefits and Special Benefits (CERB) in their income calculations for the year 2020.

    yes. There is a specific limit on number of application. A maximum of 10,000 applications will be accepted for processing as part of the 2020 PGP intake. In 2021, IRCC will open a new intake of interest to sponsor forms to accept a total of 30,000 new applications.

    Yes there are several changes at Canadian port of entry points to asses the public health and safety. They have issued more health safety protocols and expanded the quarantine rules. With all these changes, IRCC introduced rules to support greater family reunification, entry for compassionate reasons, and the safe and gradual entry of some international students. As per IRCC, More specifically, these processes will provide for the entry of

    • certain extended family members of Canadian citizens and Canadian permanent residents, including those in an exclusive dating relationship of at least 1 year and their dependent children, as well as adult children, grandchildren, siblings and grandparents
    • foreign nationals for compassionate reasons in specific circumstances, such as life-threatening illness, critical injury or death, with potential limited release from quarantine
    • international students, starting October 20, 2020, if they will be attending a designated learning institution that has been identified by their provincial or territorial government as having a COVID‑19 readiness plan in place

    Detailed information on who may qualify as an extended family member and the process and requirements to be eligible to travel to and enter Canada will be available on the Immigration, Refugees and Citizenship Canada website on October 8, 2020. There will be a robust process in place for extended family members, and each traveller will need to apply for and be issued an authorization before they can travel to Canada.

    You can have both options of visitor record application and work permit application. You need to apply on the basis of your study permit documents not the co-op work permit. Co-op work permit has a primary objective to do work related to your study course work. For your spouse, the proof of family member in Canada is linked to your study permit.

    You can not apply for study permit extension from outside Canada. If your studies are online it is fine that you can study while you stay outside Canada. As you mentioned you study has been extended and you will require extension of study permit as well. For that, you need to apply for study permit application from outside Canada like initial application which will be processed at a visa office outside Canada. It would be better if you enter Canada before the expiry of your study permit and visa and apply extension from within Canada. Biometrics are exempted in Canada for temporary applications while visa office outside still require biometrics to process the application.

    Gift of Deed is a supportive and irrevocable monetary gift coming from your siblings, parents and close relatives. This gift must be executed with faithfulness and relevant gift of deed document duly sign by the giver, the receiver and 1 witness must be presented.

    Yes. You can use Gift of Deed for your application but you should deposit the gifted money to your bank account as well and submit the letter from the giver to the receiver with six months of bank statement of giver’s bank account. You should make sure you prove the relationship with your relative.

    ‘A clear and legible copy of biological page was not provided’, can have many reasons. It could be that:

    You have not provided a unclear copy of passport pages

    or you have not provided all the pages who have biological information

    or you may have missed some pages of the passport

    or you may have provided some pages clear and some pages unclear

    you can find the detailed reason of refusal in the GCMS notes by the officer. You can try again by uploading a clear copy of all pages of passport in a one scanned pdf file.

    There is no problem with studying in a different location than that mentioned on your study permit. You can study online from anywhere in Canada. As for working part time, the only restrictions are that you can work only 20 hours off-campus. The employer listed on your co-op work permit is only for the course work of your program of study. The co-op work permit has nothing to do with part-time work during studies.

    No. Your husband cannot sponsor you without a marriage certificate. You need to apply for the official marriage certificate from the province in which you got married. You can apply online or via mail. Online is faster than mail service.

    No. It is not mandatory to change or add spouse name on Indian passport while applying for spousal sponsorship application. It is totally fine if you have single name on your passport. You can provide IRCC with alternative documents to prove your marital relationship. You can submit:

    Letters, printed text messages, emails, social media conversations, other documents proof of contact

    Proof of visits to each other, airline tickets, passport pages, boarding pass

    Proof of joint property, bank account, Joint utility accounts, life insurance, vehicle insurance

    Copies of government issued documents showing same residential information

    Other jointly held accounts such as phone bills, credit card statements, tax forms etc.

    As per CRS scores mentioned by you that is 459, Your Fiance should make an express entry profile. The current CRS score cut off for Canadian Experience Class was 454. There will be next draw in coming days which can be around 454-460. If she has an active express entry profile, she can have chance to receive an Invitation to Apply.

    1. Yes. We can help her for Canadian Experience Class application.

    2. If her mother already has a valid visitor visa for Canada. She needs to have a written authorization for travelling to Canada by IRCC. This is totally based on the purpose of visit. You can plan your wedding in April 2021 and call her mother to be a part of it as an immediate family member. You can still go for the civil marriage first and religious marriage later on if there is an issue of status in Canada for Arshpreet. Otherwise, Arshpreet can still go for her own application under CEC class. If you have further questions, feel free to ask.

    You need to present proof of funds in such a manner that they are available to the applicant directly for his use for the purpose of study. It should not be in somebody else’s bank account and that person is just saying he will give access to money. Proof of funds should be well documented with affidavit of financial support or deed of money gift to applicant. Applicant can transfer that money to his or her own account so he can have access to that money. This can be supported with showing transfer of money from father’s account to daughter’s account. Along with this, also provide proof of funds by the applicant herself and her husband which will demonstrate scope of future settlement.

    Your parents are allowed to travel to Canada. You can see the official guidelines given by IRCC below:

    If the COPR and PRV were issued on or before March 18, 2020 but are now expired, the applicant is exempt from the travel restrictions. The applicant can travel to Canada for non-discretionary reasons with the COPR and PRV in order to settle and live in Canada as a permanent resident and must have an acceptable plan to quarantine for 14 days in Canada.

    You need to email IRCC with expired COPR They will asked some additional information to confirm the travel requirements and then you can book airline ticket for your parents.

    You have already reported changes in your marital status to IRCC. Therefore, you have received a letter to provide information about your spouse. You will have to fill out the requested immigration forms for your husband and submit birth certificate, passport, identity documents, educational documents, and police clearance certificate for him. After this your spouse will be assessed for his eligibility and background check. He will be requested to undergo biometrics and medical exam. It will add on additional processing time of about 8-9 months to your application. You need to wait until processing of your spouse’s application completes. You and your spouse will get passport request together again.

    These delays are because of Covid-19. You have only one option to wait until you received any letter or update on your application. Once you receive application number, you can immediately update the pregnancy of your wife to IRCC. You can attached doctor’s letter, ultrasound report as proof of pregnancy.

    You need to mention about USA travel history, Even if you enter Canada on the same day. You can fill a new physical presence calculator, with every exit and entry to Canada. If you are not sure with which dates to put on, you can order your travel history dates from USA. Put approximate dates of entry to Canada. This way you can response the further information requested by IRCC.

    The official processing time as per IRCC website is approximately six months for dependent spouse work permit applications. But IRCC is taking more time due to pending biometrics requests for the applicant. The main cause of delay in processing is closure of biometric collection centres in and outside Canada. You have to wait patiently for further response by IRCC. The application submitted in March 2020 are still in process and deadlines to provide biometric are automatically extended.

    Yes. The immediate family members of Canadian citizens and Permanent residents of Canada are exempted from any travel restrictions. They must need a quarantine plan.

    The immediate family members of temporary residents of Canada need to obtain a written authorization from IRCC to enter Canada. As per IRCC,

    ‘To board your flight to Canada from a country other than the US, you must have written authorization from IRCC to fly to Canada. ‘

    No. You can not apply for divorce unless you have marriage certificate. It will asked by the court where you will apply for divorce. You need to apply for marriage certificate first. Once you receive marriage certificate, you will attach this with your divorce application to the court.

    There is an update for biometrics on In Canada PR applicants. As per IRCC:

    ‘Service Canada Centres are gradually resuming biometrics collection services for permanent residence applicants who have received a biometric instruction letter (BIL).

    Service Canada officers will call you at the telephone number you provided in your application to schedule your biometrics appointment. There is no additional fee to pay, and you don’t need a new BIL. Don’t go to a Service Canada Centre unless a Service Canada Officer calls you and schedules an appointment for you. ‘

    You would need to wait for Service Canada call and act as per their instructions.

    This situation can be dealt in different ways. First of all, this is not related to IRCC, instead it is a matter of Employment and Social Development Canada. You and your employer both need to obey the terms and conditions outlines in the employment contract you must have signed at the time of LMIA. As a temporary worker, your employment contract should clearly define your: mandatory employer-paid benefits, job duties, hours of work, wages, holiday and sick leave entitlements, and termination and resignation terms. If you think your employer is treating you unfairly, you can call or write to the nearest provincial or territorial labour standards office for help.

    Second way, you can notify IRCC about non compliance of your employer but this will result in negative impact on your own application. Upon investigation of case management system, your employer or you can be found ineligible for LMIA. However, under these conditions, you can still change your employer by getting new LMIA from another employer or apply open work permit.

    Yes. A PGWP holder can work as a caregiver and use that work experience in his or her permanent resident application. No, there is no need to apply for any employer-specific work permit as open work permit allows you to work with any employer. For new pilots, they need have a caregiver eligible NOC level job offer which is LMIA exempted. A employment contract and offer is required when you starting work as a caregiver under pilots. Also, you need to go through mandatory medical examination as a requirement to work as a caregiver.

    In citizenship grant applications, if the minor meets all the requirements for citizenship, the final requirement is to take the oath of citizenship to become a Canadian citizen. As per IRCC, Minors aged 14 or over will receive a Notice to Appear with the location and time to attend a citizenship ceremony and take the oath of citizenship before a citizenship judge or presiding official. Once the oath is taken, you will receive the minor’s certificate of Canadian citizenship.

    Minors under 14 years of age are not required to take the oath of citizenship at a ceremony. However, minors are welcome to attend a citizenship ceremony. If you would like them to attend a ceremony, please check “yes” box in Question 11 on the application. If your child does not attend the oath ceremony, the certificate of Canadian citizenship is mailed to the parent/guardian.

    The part time studies you did, for the summer semesters due to your Co-op hours, is totally fine. It does not make you ineligible for post graduation work permit. The problem is the one winter semester in which you dropped voluntarily to become part time student. This winter semester was not the final semester, that would have made you ineligible for PGWP.

    You have one option to apply for a new program of study and obtain PGWP on the basis of that new program, or to find work supported by LMIA. The PGWP is very clear on eligibility and accepts part time studies only in the very last semester of study.

    No. You will not be facing any issues upon your entry to Canada as you have valid PR card. Once you are in Canada, you should meet the residency obligation of 730 days should be spent in Canada. If you meet the residency obligation, you can apply for renewal of your PR card.

    You can not apply PR card renewal outside Canada but you can apply for PRTD outside Canada to make yourself eligible to get entry in Canada as a permanent resident. If the VAC is closed you can apply via email as per instructions given by IRCC. If you have a flight within 6 weeks of the application, you can mark the application as urgent. Below are the instruction given by IRCC:

    ‘If you’re outside Canada and your PR card is expired, you need to apply for a PRTD to return.

    The instructions were given clearly by IRCC prior to the opening of expression of interest system which were as follows:

    – Don’t submit the expression of interest form more than once.

    – Duplicate entry won’t increase your chances of being invited to apply.

    – IRCC will remove any duplicate entries.

    An Officer may use his/her discretionary powers that you have tried to misuse the system by submitting more than one expression of interest for the same persons to gain the more chances to be invited.     No. You can not be eligible for this new guidelines for health professionals who are refugee claimants. First of all, your husband’s claim is not accepted, making him not a refugee claimant anymore. Secondly, your permanent resident application under Canadian Experience Class is already in process. You can not submit another PR application at the same time.

    This PR pathways has following eligibility criteria:

    • Have claimed asylum before March 13, 2020.
    • Have obtained a work permit after making an asylum claim
    • Have worked in the health care sector, in health institutions
    • Have worked for at least 120 hours between March 13, 2020 and August 14, 2020.

    You must update your passport details in your CEC application. You can do it by submitting an IRCC web form and upload the new copy of your passport. Make sure you fill in all the details carefully in the web form. If you are applying from within Canada, there will be no passport request instead there will be a landing interview in Canada.     You can sponsor your husband because you do not receive any social assistance other than for reason of disability. ODSP is social assistance based on disability. You still have to sign the undertaking to provide the basic means to your husband.     Yes. You can request for a reconsideration and a Judicial Review (JR) for your application. There is no restriction on the proof of funds provided by the in-laws family. Anyone can provide the funding for education of the applicant as long as the purpose of study is genuine. You should go for a better documentation of application and use some professional experts on this matter. They will include proper case law related to your scenario in their submissions. Another thing, You can ask your in-laws to provide an official affidavit of financial support along with proof of funds submitted. You should have access to the money which is shown as proof of funds.     No. He can not sponsor his wife. Proxy marriages are Recognized in Canada. If one or both parties are not physically present at the ceremony, their marriage won’t be recognized. There are some exemptions. But in your friend’s scenario, he can not sponsor his wife.

    No. You can not use these certifications to support your language proficiency. If you’re 18 to 54 years of age, you must submit proof that you can speak and listen at the Canadian Language Benchmarks (CLB) Level 4 or higher in English or French. Send a copy of proof that you completed or are attending a program with your application which can be your diploma, degree, or any educational certificates. You can write a language test again and obtain CLB level 4 or above and submit its result with your Canadian citizenship application.

    As per my understanding of this question, the answer is there is no pause on the restoration period. Once status is lost, there are 90 days to apply for restoration application. If you will submit application within this period, your application will be processed and will take a bit longer than normal application. If your application gets refused then there will be no time left for restoration as 90 days are already over. There is very rare chance that you will get an option to apply restoration application again. To know if you are eligible to apply for restoration, it is usually mentioned in the refusal letter.     No. He can not work on implied status if he has applied for employer specific work permit. There is provision to work on implied status only for a Post-graduation work permit. He has to wait until he receives his work permit. He can only work if he has applied PGWP because Study permit comes with OWP which allow students to work part-time (on-campus or off-campus) with the condition of being full-time student. It is also only applicable when student applied PGWP before the expiry of their study permit.

    There will be no effect on your express entry application if you express entry profile expires. Permanent application is a new application which comes automatically in your account upon receiving an ITA. There is no need to make any new profile because you have already got invitation and applying for permanent residency. Moreover, a new profile will have different number than the one mentioned on your ITA.

    An officer can not stamp passport beyond the validity of it, it is a mistake happened on officer’s part. You can apply for visitor record application with a new passport and for proof of legal status you can use those stamps of entry. You can explain the situation in an additional letter.

    In your situation, there could be two possible ways.

    As you are already in Canada for more than six months, you must have applied for visitor record application. If yes, you do not need to apply for any application at the moment. If you are planning to travel, then you need to apply a new visa on new passport while re-entering Canada. You can not replace the same counterfoil on your old passport. You need to apply new visa from outside Canada. However, you can still extend your stay in Canada with new passport. While doing this, you can use photocopy of old visa and entry stamp as proof of status in Canada. If you are out of status, I would suggest you to go for restoration of your status as soon as possible and explain the circumstance in well manner.

    I hope that you had reported your lost passport to the local police station around your area. Make sure you keep your passport safe in future to avoid these hard situations.

    I would suggest that you Should decline this invitation to apply. In express entry profile, the place where they ask question for the relatives in Canada, you need to put the names of any family members who are permanent residents or citizen of Canada. Your brother is on study permit therefore you cannot get any CRS points for sibling in Canada. So if you proceed with this ITA without explaining about the fact that you were never aware about this mistake. You will get a letter of procedural fairness and you could be banned for misrepresentation to IRCC. If your scores are more than the cut off, you should decline this invitation to apply and submit your profile again with the correct information. Hopefully, you will get a new invitation to apply in the upcoming round and then you can proceed with submitting your application.

    It is always advised that you should compare the CRS points at the time of invitation and the time you will complete your profile to submit the final application. If your points are less than the cut off of the round of invitation you are invited to, you should decline this invitation. If your points are less than before but they are still more than the cut off, you should continue with this invitation and explain the decrease of points in additional information. In your case, your CRS points are increased then the points at the time of invitation has received. You don’t need to worry about it because you have not changed any details in the profile. It could be a system glitch. You should submit your application with all the supporting documents. There is no need of any explanation about the increase of points unless you are providing all documents for the points you claimed at first place.
