It depends upon the size of her family today. You can add her in-laws she sponsored 5 years ago and add her parents, she is thinking to sponsor now. that will be the family size. The responsibility for parents and in-laws will be for 20 years from the date of their landing as per the undertaking agreement.

No police clearance certificate (PCC) is required for the study permit application but Immigration, Refugee, Citizenship Canada (IRCC) or the Canadian Consular can ask for one. It is not a bad idea to have one for your own personal records just in case. It also depends on your country of residence.

No. If you’re eligible to work off-campus, you can work up to 20 hours per week while classes are in session. During scheduled breaks, like the summer or winter holidays and spring break, you’re allowed to work more than 20 hours. You can only start working in Canada when you start your study program. Your 20 hour per week can not be accumulated, if you did not work before.

A visitor record is a status document issued to visa-required or visa-exempt foreign nationals who are seeking to enter or are in Canada. It specifies the conditions and validity period of their temporary stay in Canada. A visitor record may be issued to specifies the validity date (or date by which the foreign national must depart Canada)

A TRV (usually called a visitor visa) is a sticker in your passport that allows you entry to Canada if you are from a visa required country. Currently, most visitors to Canada may visit for up to six months when they first enter Canada. Visitors who wish to stay longer must apply for an extension, and pay a new fee.

She can apply for a name change in Ontario due to marriage, divorce, death of a spouse or any other valid reason. You have to be living in Ontario for at least 12 months. You need a name change certificate for any legal document changes such as PR Card, Citizenship Certificate, Passport, CPP record etc. It is always good to have your Legal name change certificate to avoid any problems.

Yes, she can sponsor her spouse while receiving CERB. There is no income requirement for sponsoring your spouse as long as you can prove you will be able to support your spouse.

Please go ahead and apply for PGWP explaining your correction or the amendment to your study permit. Apply for the verification of the status (VOS) separately. No need to worry about anything.

    Dear Ramanpreet

At present, IRCC is only inviting those people for the Zoom based Citizenship Oath Ceremony who has some sort of emergency like a death in the family, sickness, job requirement or any other urgent and valid reason. They have written or sent emails to all people whose oath-taking ceremony was cancelled due to Covid-19. If you have an emergency, you can write to them with proof of urgency and they will get back to you eventually. No one can predict when things will return to normal due to this Covid-19. Good luck and all the very best. Thanks

    Hello Inderpreet,

Anyone can apply for permanent resident in Canada based on the H&C grounds as long as they have compelling reasons. It all depends on individual circumstances. Your parents are here on super Visa, they can stay with you up to 2 years at a time. When the parents and grandparents sponsorship opens, you can apply for their permanent resident visa as long as you are here for 3 years and meet the financial requirements for 3 years in addition to other qualifying requirements.

    Hello Ravinder,

IELTS or CELPIP test results are NOT required at the time of submitting the application for a study permit as long as you have been unconditionally accepted by the DLI (Designated Learning Institute) in Canada. Having said that you will need IELTS OR CELPIP results at the time of submitting the Permanent resident (PR) Application. IELTS OR CELPIP results are valid for a period of 2 years from the date of issue. It depends what you want to do, what are your plans and what you want to accomplish. Good luck.

    Hello Parminder,

You can not renew the Super Visa or reapply for Super Visa for parents and grandparents within Canada. On its expiry or before its expiry you have to re-apply for a Super visa for your parents in the country of their residence (India). When they are in Canada, you can only apply for the Extention of their stay in Canada. If they want to extend your stay in Canada, they should apply at least 30 days before their status expires.

In order to apply for the super visa, you will need all the required paperwork again such as application, letter of invitation, required fee, Notice of Assessment, Job Letter, Medical report and the health insurance from a Canadian company.

The validity of the super visa issued to your in-laws is in effect till its expiry whether they want to come back or not. You will have to take them into consideration when applying for Super Visa for your parents. All the family members in your family have to be included in addition to the people sponsored before and people being sponsored now. So the count for the qualifying Income is 8 and NOT 6.

    Hello, Harjap

It is always a good idea to apply for the multiple entry visitors visa. Let’s try to understand first what is a multiple entry visa? A multiple entry visa allows visitors to come and go from Canada for six months at a time, without having to reapply each time. It can be valid for up to 10 years, or one month before your passport expires, whichever is earlier. You must arrive in Canada on or before the expiry date on your visa.

When you are issued a multiple entry visa with a validity of up to 10 years, you do not have to apply again and again. Although you may have 10 years multiple entry visitor visa, the duration of your stay in Canada depends upon the discretion of the visa officer at the port of entry. Usually, you are granted a stay of 6 months unless otherwise indicated by date under the immigration stamp on your passport.

10-year multiple entry visa does not mean they can automatically stay for 6 months when you land in Canada. When a visitor visa is issued in the country of your residence, it means that you can board the plane and come to Canada. The CBSA officer at the airport decides how long can you stay in Canada. In your case, the officer did not feel comfortable and had doubts about your in-laws and hence restricted their stay in Canada. Sometimes they cancel the visa too. Once your in-laws go back they should stay for a longer period in their country of residence. If you want them to stay for more than 6 months, you should apply for the Super Visa or sponsor them.

Orphaned relatives may be sponsored provided that they are under 18 years of age, unmarried and not in a common-law relationship and are the sponsor’s brother or sister, nephew or niece or grandchild. In all cases of orphaned relatives, officers must request written consent of the appropriate authorities in the country of residence of the child, before the child may be removed from that country.

Your husband does not to be working to sponsor you (only true in case of spousal sponsorship) but he must give an explanation in writing that how he is going to support you. He may have saved money in the bank, Fixed Deposits or GIC, Tax-Free Saving Account (TFSA), Letter of Support from his family or friends, Self-employed income (part-time teaching) or you may have some funds back at home which want to bring to Canada. When he sponsors you, he signs an undertaking to provide you with the basic necessities of life including food, shelter, boarding, lodging, medical and entertainment for a period of three years. Good luck!

There are different types of work permits you can apply depending upon your situation. Mainly there are two types of work permits – Open work permit and Employer Specific Work Permit (requires approved LMIA or the approved Job offer)

If you are a student studying in Canada and has successfully completed at least 8 months of study from a Designated Learning Institute (DLI) approved by the Provincial Government, you can apply for the Post Graduate Work Permit (PGWP). If your spouse has an open work permit (e.g. post-graduation work permit), you must attach a copy of your spouse’s work permit to your application for an open work permit, along with:

    • a letter from your spouse’s current employer that confirms they work there in a NOC 0, A or B occupation, or a copy of your spouse’s employment offer or contract, and
    • a copy of your spouse’s recent payslips
    • Your permit will not be valid longer than your spouse’s work permit.

If you have a spouse working in Canada on an open work permit, you can also apply for the open Work Permit.
